Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the TECH PROBIZ website and your purchase or use of our website design, website development, and related digital services. By purchasing our services or engaging with us, you agree to be bound by these Terms.
1. Definitions
Client: Any individual, business, or organization engaging TECH PROBIZ for website design, website development, or related digital services.
TECH PROBIZ: The website development and digital services provider responsible for designing, developing, and delivering websites and related digital solutions.
Project: The website design, development services, features, functionality, and requirements agreed upon in a written proposal, quotation, invoice, or service agreement between TECH PROBIZ and the Client.
Deliverables: The final website, design elements, source files where applicable, content, and other digital materials created and delivered as part of the agreed Project.
2. Website Development Packages and Pricing
TECH PROBIZ currently offers the following website development packages:
- Starter Web Design — One-Time Charge: $99
- Basic Business Website — One-Time Charge: $499
- Ecommerce Website Development — One-Time Charge: $799
- Custom Corporate Website — One-Time Charge: $999
- Landing Page Design — One-Time Charge: $150
Package pricing applies only to the services and features specifically included in the selected package.
Additional pages, custom functionality, revisions beyond the included amount, premium plugins, third-party software, hosting, domain registration, paid subscriptions, integrations, content creation, or other services may require additional fees.
3. Engagement of Services
3.1. By purchasing a package or approving a proposal, the Client agrees to engage TECH PROBIZ for the services described in the applicable package, proposal, invoice, or agreement.
3.2. TECH PROBIZ will make reasonable efforts to provide services professionally and in accordance with the agreed project requirements.
3.3. Any services not specifically included in the agreed scope may be treated as additional work and may require a separate fee.
4. Payment Terms
4.1. All payments must be made according to the pricing and payment schedule agreed upon between the Client and TECH PROBIZ.
4.2. TECH PROBIZ may require full payment, an upfront deposit, or milestone payments before beginning or continuing work.
4.3. Work may be paused if required payments are not received within the agreed timeframe.
4.4. Additional pages, features, functionality, revisions, or services requested after approval of the original scope may require additional payment.
5. Project Timeline and Delivery
5.1. Standard website projects are generally completed within 1 to 7 business days, depending on the selected package, project requirements, complexity, and availability of required materials.
5.2. The estimated delivery period begins once TECH PROBIZ has received the required content, information, access, approvals, and applicable payments from the Client.
5.3. Delivery timelines may be extended due to delays in receiving content, feedback, approvals, credentials, or other required materials from the Client.
5.4. Unforeseen technical issues, third-party service interruptions, or circumstances outside the reasonable control of TECH PROBIZ may also affect delivery times.
6. Client Responsibilities
The Client agrees to:
- Provide accurate and complete project information.
- Provide required text, images, logos, branding materials, and other content.
- Provide necessary website, hosting, domain, or third-party access when required.
- Ensure that supplied content is legally authorized for use.
- Review and provide timely feedback on project work.
- Provide approvals necessary to move the Project forward.
TECH PROBIZ is not responsible for delays caused by the Client’s failure to provide required information, materials, access, or feedback.
7. Revisions and Changes
7.1. The Client may request revisions according to the number of revisions included in the selected package or agreed Project scope.
7.2. Revisions must relate to the original project requirements.
7.3. Requests for additional pages, major design changes, new functionality, new features, or requirements outside the original scope may be treated as additional work.
7.4. Additional work may result in additional fees and an updated delivery timeline.
8. Website Content and Third-Party Materials
8.1. The Client is responsible for providing or approving the content used on their website.
8.2. The Client represents that they have the necessary rights, licenses, or permissions to use any text, images, logos, videos, trademarks, or other materials they provide.
8.3. TECH PROBIZ is not responsible for copyright, trademark, licensing, or other legal claims arising from materials supplied by the Client.
8.4. Third-party themes, plugins, software, APIs, hosting, domains, stock assets, and other external services may be subject to separate terms and fees.
9. Ownership and Intellectual Property
9.1. Upon receipt of full payment, ownership of the completed website and final agreed Deliverables will be transferred to the Client, subject to any third-party licenses or restrictions.
9.2. TECH PROBIZ retains ownership of its pre-existing tools, templates, frameworks, reusable code, development methods, processes, and proprietary resources.
9.3. Third-party software, plugins, themes, images, fonts, or other licensed materials remain subject to the terms of their respective owners or providers.
9.4. Unless otherwise agreed in writing, TECH PROBIZ may display completed Projects or publicly available websites in its portfolio and marketing materials.
10. Confidentiality
10.1. Both parties agree to protect confidential or proprietary information shared during the Project.
10.2. TECH PROBIZ will not knowingly disclose the Client’s confidential business information to unauthorized third parties except where disclosure is required by law or necessary to provide the agreed services.
11. Termination
11.1. Either party may request termination of a Project through written communication.
11.2. The Client remains responsible for payment for work already completed, approved milestones, and non-refundable third-party expenses incurred before termination.
11.3. Any refund following termination will be handled in accordance with the TECH PROBIZ Refund and Returns Policy.
11.4. Upon termination, TECH PROBIZ may discontinue any remaining unpaid services.
12. Website Maintenance and Future Changes
Unless specifically included in the purchased package or service agreement, ongoing website maintenance, updates, security monitoring, content changes, technical support, hosting, and future development are not included after project completion.
Additional maintenance or development services may be purchased separately.
13. Limitation of Liability
13.1. TECH PROBIZ will make reasonable efforts to deliver functional websites according to the agreed project requirements.
13.2. TECH PROBIZ shall not be liable for indirect, incidental, special, consequential, or business losses resulting from the use, inability to use, or performance of a website or service, to the extent permitted by applicable law.
13.3. TECH PROBIZ is not responsible for problems caused by third-party hosting providers, domain registrars, plugins, software, APIs, payment processors, or other external services.
13.4. The Client is responsible for maintaining appropriate backups and ensuring that their website and business information remain secure after project completion.
14. No Guarantee of Business Results
TECH PROBIZ provides website design and development services but does not guarantee specific business outcomes, including a particular number of visitors, leads, sales, rankings, revenue, or conversions, unless a specific guarantee is expressly provided in a separate written agreement.
15. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the applicable laws of the United States, without regard to conflict-of-law principles.
Any disputes arising from these Terms shall be handled through the appropriate legal process and courts having jurisdiction over the matter.
16. Changes to These Terms
TECH PROBIZ reserves the right to update or modify these Terms and Conditions from time to time.
Any changes will be posted on this page with an updated Effective Date. Continued use of our website or services after changes are posted may constitute acceptance of the updated Terms.
